Under what circumstances can one file a state compensation claim?

  1. In the case in which civil servants intrude upon the citizen’s freedom or rights either intentionally or negligently in the course of performing their duties as the responsible party, or in the case in which the citizen’s freedom or rights are infringed stemming from omission of civil servants in the performance of their duties, the citizen is eligible to file a state compensation claim.
  2. In the case in which the citizen’s livelihood, body, or property suffers damage, injury or harm resulting from a defect in the installation or management of any government-owned public facility, the citizen is eligible to file a state compensation claim.
