Official Functions and Competence
(I) Legal Affairs
1. Formulation of self-government ordinances and regulations
(1)We regularly provide legal advice to City Government agencies to enact, revise, and abolish Taipei's self-government ordinances and regulations and administrative rules.
(2)Establish an online laws and regulations database. We now provide the general public with a quick and easy access to the database. The database is being updated in a timely fashion.
(3) We constantly collect, publish and update government rulings to laws and regulations.
2. Studies on laws and regulations
(1) We provide legal opinions in every aspect of law to the City Government agencies to uphold the rule of laws principle and enhance services to the general public.
(2) Pursuant to the development of legal system and government reform project, we propose law amendments to the central government if necessary. We offer legal education training programs and promote legal reforms.
(II) State Compensation
1. The State Compensation Law and relevant regulations are applicable in case of any damage arising from an intended or negligent act of any employee of the City Government acting within the scope of his or her office or employment in a way that infringes upon the freedom or rights of any person. Also in case of damage to a person's life, body, or property resulting from a defect in the installation or management of any city government-owned public facility, whereas the City Government shall negotiate with the claimant and exercise the right to reimbursement from those who are liable for the aforementioned damage.
2. The claimant may request to appear in person in the State Compensation Committee meetings to present his/her claim.
3. To increase the efficiency of state compensation procedure, the State Compensation Committee meetings are being held on a monthly basis.
(III) Consumer Rights Protection Pursuant to the Consumer Protection Act and relevant regulations, Consumer Protection Officers of the Department handle consumer complaints. The Consumer Disputes Mediation Committee mediates consumer disputes that occur in Taipei City.
(IV) Government Procurement Complaints Reviews The Complaint Review Board for Government Procurement of the Taipei City Government reviews complaints and mediates contract performance disputes in accordance with the Government Procurement Act.
(V) Human Rights Protection According to the Program for protection and promotion of human rights of Taipei City, which was implemented since 2004, Human Rights Protection Advisory Committee of Taipei City Government will be held on an irregular basis according to actual needs, and the City Government will publish monographs or books with regard to its efforts on improvement of human rights conditions and issues from time to time.
(VI) Administrative Appeals Commission The primary task of the Commission is to review appeals against administrative actions taken by the City Government agencies, which the appellants find unlawful or improper and resulting in harm to their rights and interests, in accordance with respective laws and regulations.
