According to the State Compensation Law, the liability for compensation belongs to the government authority in which the civil servant responsible for the damage works or the government authority responsible for the installation or management of the public facility that caused the damage. Therefore: -
- One should file a state compensation claim with the government authority with the obligation to provide compensation when it has been determined that such authority is responsible for the damage claimed by the claimant.
- In cases under the jurisdiction of the Taipei City Government, when it is unclear which authority is responsible for damages caused, the claimant can mail relevant data to the “State Compensation Committee of the Taipei City Government” (address: 9th fl., North-east Wing, No. 1, Shi-Fu Road, Xinyi District, Taipei City); the Committee will then forward the data to the relevant authority to handle the case.
